These Terms of Service ("Terms") govern your use of Provaprep. By using Provaprep, you agree to them. If you do not agree, do not use it.
Provaprep ("we", "us") is an independent study product operated from the State of Florida, USA. You can reach us at support@provaprep.com.
These Terms cover everything we run under the Provaprep name: this website at provaprep.com, the app at app.provaprep.com, and any mobile version of the app we release later. We refer to all of it below as "the app".
Two other pages form part of this agreement: our Privacy Policy, which explains what we do with your information, and our Refund Policy, which sets out when we give money back.
The app is a study tool for people preparing for U.S. real estate licensing exams. It is an independent educational product: we are not affiliated with, endorsed by, or connected to any state real estate commission, licensing authority, or official exam provider. Using the app does not guarantee that you will pass any exam. Exam content, rules, and requirements vary by state and change over time; you are responsible for confirming your state's current requirements with the official licensing authority.
Nothing in the app is legal, financial, or professional advice, and none of it satisfies a state's pre-licensing education requirement. It is practice, not a course.
You must be at least 18 years old to create an account or buy a subscription. The app is built for adults preparing for a professional licensing exam and is not directed at children.
Provaprep is sold in the United States only, and all prices are in U.S. dollars. If you subscribe from outside the United States, contact us and we will cancel and refund you, however long ago you paid.
You can try the app without an account: your first 10 questions are free and are stored only on your device. Beyond that, a free account is required to keep using it. The free plan stays free, with no card and no charge.
An account is yours alone. Keep your password to yourself, do not share your login, and tell us at support@provaprep.com if you think someone else is using it. What happens under your account is your responsibility. Give us an email address that reaches you, since that is how we send account and billing notices.
You can close your account at any time from Settings inside the app, or by emailing us. Closing an account does not by itself cancel a paid subscription or trigger a refund; see the two sections below.
Our Refund Policy is part of these Terms and is where the detail lives. In short: your first payment is refundable for any reason within 48 hours, and after that we refund any billing period in the last 30 days in which you did not use the app at all. We do not prorate part of a period. Billing errors, such as a double charge or a charge after cancelling, are always put right and are not treated as refund requests.
You may use the app for your own personal, non-commercial study. You may not:
The app, including its question bank, explanations, design, and code, is our property and is protected by copyright and other intellectual property laws. These Terms give you a limited, personal, revocable license to use the app for study; they do not transfer any ownership to you.
Our Privacy Policy explains what we collect and how it is stored, including that your study progress is kept on your device and, once you have an account, mirrored to our servers so it follows you between devices. We do not sell your data and the app carries no advertising. You can delete your account and its server copy at any time from Settings inside the app, or by emailing support@provaprep.com if you would rather we did it.
We add, change, and retire features as the product develops, and we update study content as exam requirements change. What is included in each plan can change too; if a change materially reduces what your current plan gives you, we will tell you before it takes effect and you can cancel. We aim to keep the app available but do not promise uninterrupted service.
We may suspend or close an account that breaks these Terms, particularly the acceptable use rules above, or that we reasonably believe is being used fraudulently. Where the situation allows it, we will tell you first and give you a chance to put it right.
If we close a paid account for a reason that is not your fault, we refund the period you are in. If we close it because of a breach, we do not.
You can stop using the app at any time. The sections on intellectual property, disclaimers, limitation of liability, and governing law survive the end of your account.
The app is provided "as is" and "as available", without warranties of any kind, express or implied. While we work to keep study content accurate and current, we do not warrant that all content is error-free or reflects the most recent laws or exam requirements in your state.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app, including exam outcomes. Our total liability for any claim related to the app is limited to the amount you paid us in the 12 months before the claim arose.
Some states do not allow certain limitations, so parts of this section may not apply to you.
We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page. Continued use of the app after changes take effect means you accept the updated Terms. The version in force on the day you were charged is the one that applies to that charge.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts located in Florida, and we both agree to that venue. Either of us can still bring a qualifying claim in small claims court.
Please email support@provaprep.com before anything formal. Most of what reaches us is a billing question, and those are quicker to fix directly.
These Terms, together with the Privacy Policy and the Refund Policy, are the whole agreement between us about the app. If any part of them is found unenforceable, the rest stays in force. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your account or these Terms to anyone else; we may transfer them if the business is sold or reorganised, on the same terms.
